Agreement to Indemnify and Hold Harmless

By reading and agreeing to this contract and clicking on agreement of terms,  I  shall indemnify, defend and hold harmless Dave Cervini Entertainment Inc d/b/a The New York Social Network and their officers, employees and agents from and against all claims, suits, actions, losses, damages, liabilities, injuries, costs and expenses of any nature whatsoever resulting from, arising out of, or relating to the activities of Dave Cervini Entertainment Inc d/b/a The New York Social Network and or its officers, employees, sub-contractors, or agents under this Contract.

Dave Cervini Entertainment Inc. d/b/a The New York Social Network is not obligated to screen the backgrounds or qualifications of any registrants or attendees at its events.  Each attendee assumes full responsibility, and holds Dave Cervini Entertainment Inc. d/b/a The New York Social Network harmless against any damages, injuries or emotional distress resulting from any contact with individuals, the venue or location where the where the activity takes place and the activities that I have participated in and willfully registered for.  I completely understand that I take full responsibility for my actions, decisions and results of those before, during and after Dave Cervini Entertainment Inc. d/b/a The New York Social Network  sponsored activities.  I also understand that the consumption of alcohol may be available and is voluntary and I take full responsibility for how much I consume and any actions or reactions associated with it. I agree to represent and disclose any medical conditions or medications that may interfere with my participating in any event including the taking of any legal or illegal substances.

By signing this I also authorize that no member of my family, spouse or guardian take action against Dave Cervini Entertainment Inc. d/b/a The New York Social Network and their officers, employees and agents in the case that I am not able to.  In addition, Dave Cervini Entertainment Inc. d/b/a/ New York Social Network event hosts and their Assistants may be Independent Contractors.  Attendee agrees to release Dave Cervini Entertainment Inc. d/b/a  New York Social Network  from any claims arising from actions taken by Event Hosts, Event Assistants, or the Venue or location in which the event takes place.

 

Members may be photographed or filmed for promotional use on our website or print materials.  Requests to have photo’s omitted from website use may be made in writing.

 

This agreement will be governed by New York State Law and will be actioned in Queens Supreme Court

I have carefully read all of the above stipulations of this agreement and I completely agree with all of the aspects.  By registering on line and becoming a member I understand that I am bound to this agreement and its terms.
